Irvin’s lawyer Levi McCathern confirmed to NBC that Irvin was under investigation, but didn’t reveal what the allegation was. Still, he told the network that Irvin “didn’t do anything wrong or inappropriate.”

In a statement to the network, the ATPD said “There has been an allegation, but we are not prepared to release any details at this time due to our investigation being in its very early stages.”

In February of 2023, Irvin was accused of touching the arm of a female Marriott employee without her consent while the two were having a conversation, “causing her to step back, becoming visibly uncomfortable.”

There was no criminal complaint made against Irvin related to the encounter. But McCathern previously told TMZ that Irvin’s reputation has not only been damaged but that he lost money in the form of canceled appearances following the woman’s allegations, including being removed from NFL Network and ESPN coverage of last year’s Super Bowl.

Marriott claimed at the time that Irvin “appeared to be visibly intoxicated” as he began his aggressive behavior toward the employee, shaking her hand, stating she was attractive, and asking her if she watched football.

Irvin filed a lawsuit seeking $100 million in damages. The suit was settled in September.
