Dallas Cowboys running back Ezekiel Elliott remains suspended after the Fifth Circuit Court on Tuesday ruled against the NFLPA’s motion to reverse a previous court order that reinstated said suspension.

There’s a lot of legal terminology here, but we’ll leave that up to the lawyers and the like. In layman’s terms, the court ruled that Elliott and the union can still seek a en banc rehearing. This means that Cowboys’ running back can file for a rehearing to reconsider the panel court’s ruling that reinstated his suspension.
Whether Elliott plays Sunday against the San Francisco 49ers remains to be seen. The NFLPA’s next course of action will be to seek an immediate injunction reinstating Elliott until further court proceedings are heard.
It was reported over the weekend that the legal system itself could enable the running back to play over the next two weeks as both the NFL and NFLPA get their ducks in a row for what could still be a lengthy legal battle between the two sides.
The case will now be heard in the Southern District of New York later Tuesday afternoon, at which point we’ll get a better understanding of whether Elliott plays Sunday.
