Von Miller arrest could provide Buffalo Bills with path to massive salary cap savings in 2024

The arrest of edge rusher Von Miller for allegations of domestic violence threatens to sideline the Buffalo Bills’ star defender indefinitely. As the NFL begins investigating the allegations and arrest, the latest off-field issue could also jeopardize’ Miller’s future in Buffalo.

Miller has faced previous allegations of domestic violence and come under scrutiny for disturbing messages sent to a partner. He was investigated for domestic violence allegations in 2023 but was never charged. His ex-fiancee also released text messages allegedly showing Miller telling her that he was “praying for a miscarriage,” instead of her having the baby.

  • Von Miller contract: $7.939 million cap hit in 2023, $23.874 million cap hit in 2024, $23.874 million cap hit in 2025, $26.374 million cap hit in 2026

On Thursday during the Bills’ bye week, Miller turned himself in to police following a third-degree felony charge for allegedly assaulting a pregnant person. He was later released from custody after posting $5,000 bond.

Buffalo Bills statement on the arrest of Von Miller

The NFL has the authority to place Miller on the Commissioner’s Exempt list, which would immediately rule him out of action. Typically, NFL players accused of domestic violence are added to the exempt list while the league investigates the matter. As of Friday morning, the NFL hadn’t announced if Miller would be placed on paid leave.

Not only is Miller’s immediate future in the NFL uncertain, but the arrest also clouds his long-term future. Already 34 years old, the future Hall of Fame edge rusher has been ineffective in his first season back from an ACL tear. Seemingly on the decline, Buffalo now has a potential cause to cut ties with Miller without significant financial penalties.

  • Von Miller stats 2023: 0 sacks, 1 QB hit in eight games played

Before the arrest, Miller’s $17.145 million salary in 2024 was guaranteed for injury. In addition, the full salary would be entirely guaranteed if he was still on the roster in March 2024. However, the contract includes clauses that allow Buffalo to void those guarantees if Miller is suspended for violating the NFL’s Personal Conduct Policy.

If Miller is suspended by the NFL before March 2024, the Bills can immediately void the $17 million Miller is owed and cut him outright. It would be especially valuable for a team that is currently projected to be $29 million over the 2024 NFL salary cap.

In the meantime, the Bills’ organization can let the league handle the matter and determine if Miller needs to be placed on paid leave. If that happens and enough evidence is found for Miller to be suspended ahead of his age-36 season, the Bills will likely release Miller in the spring.
