According to a report by ESPN, attorney Ted Wells, who compiled the Wells Report leading to the four-game suspension of New England Patriots quarterback Tom Brady, will be present at Brady’s appeal hearing scheduled to take place on Tuesday.

The report concluded that Brady had probable knowledge that footballs used in the AFC Championship game against the Indianapolis Colts had been tampered with by Patriots locker room personnel.

After the report was released, Brady was handed a four-game suspension by the NFL—a suspension he is appealing.

Brady will be represented by Jeffrey Kessler, outside counsel for the NFL Players Association. It is reported that Wells will be present to answer questions from Brady’s representatives and from commissioner Roger Goodell. Goodell will reside over Brady’s appeal and will ultimately decide if the suspension will be reduced, removed or stand as is.

For Brady’s side, they will claim that the commissioner violated the Collective Bargaining Agreement (CBA). It is also reported that Brady’s side will detail that the Wells Report “grasps at dubious, contradictory and mischaracterized circumstantial evidence.”

Brady’s representatives will argue the report did not provide a legal basis to impose the discipline that was handed down.
