Judge Rules Some Evidence in Aaron Hernandez Case Can Be Suppressed

The judge in the Aaron Hernandez murder trial ruled on Tuesday that some of the evidence that authorities seized during their raid of Hernandez’s North Attleboro home prior to indicting the former NFL tight end was acquired illegally (via Boston.com). 

During an Aug. 11 hearing, defense lawyers for Hernandez said the seizure of cellphones, electronic tablets, a video recorder, and a hard drive from Hernandez’s North Attleboro home was illegal.

Judge Susan Garsh, of Bristol County Superior Court, agreed.

While it remains to be seen if any of this evidence is considered a major part of the state’s case against Hernandez, it’s important to note that most of the evidence pointing to Hernandez in the murder trial of Odin Lloyd is circumstantial.

In terms of this specific evidence, Hernandez’s lawyers successfully argued that Massachusetts State Police failed to follow proper protocal when removing the items from Hernandez’s house.

The first-degree murder trial is set to begin early next year.
